Under most circumstances, in order to file for a divorce in North Carolina you must be separated for one year, you must be a resident of North Carolina for six months prior to filing, and you must have the intent of making North Carolina your permanent home. If you meet these criteria, you can obtain an absolute divorce. Even if there are other issues that need to be addressed, such as children and debts, this will not stop you from obtaining a divorce.

If you have not been separated for one year, you can not yet obtain an absolute divorce, you may qualify to get a legal separation, otherwise known as a divorce from bed and board. If you do meet these criteria, an uncontested divorce is relatively simple to obtain. In fact, under most circumstances we can obtain an absolute divorce for you without you ever having to be present.

Whether or not you meet the criteria for an absolute divorce, or a divorce from bed and board, you may need to resolve all of the other issues involved when you and your spouse have decided to separate, such as post separation support, alimony, child custody, child support, and equitable distribution. This can be handled through court proceedings or, if you and your spouse are in agreement on all of these issues, this can be handled through a separation agreement.
